Terms of Service

1. Who you're dealing with

Hevin Design is a sole trader business based in South-West Sydney, trading under ABN 58 368 892 845. When these terms say "we" or "us", they mean Hevin Design. When they say "you", they mean the business we're working for.

2. What we offer

We design and build websites, websites with the system behind them (things like online quoting, ordering, bookings, customer portals and dashboards), Shopify online stores, and ongoing care after launch. We also offer fixed-price 48-hour jobs (a Quick Fix to an existing site, a one-page site, or a restaurant menu site with pickup ordering), small websites of up to five pages, and add-ons: logo design, brand kits, business cards, email signatures, business email set-up, Google Business Profile set-up, booking calendars, extra pages, photo galleries and payment links. Some of this work, such as logos and branding, may be done by people we work with; we stay your one point of contact and we're responsible for it. We don't offer marketing or advertising management.

3. Quotes and scope

Full projects start with a free call and a free written quote. Fixed-price jobs (Quick Fix, one-page site, menu site, small website and add-ons) start from the price on the site: you send the details, we confirm the price and a delivery date in writing, and there's no call needed unless you want one. Either way, the quote sets out what we'll build, the price and a launch date. The price is fixed: it doesn't change unless you ask to change the scope. If you do, we'll quote the change in writing, and we won't start it until you've agreed.

4. Payment

Prices are in Australian dollars. We're not registered for GST, so no GST is added to any price or invoice. You pay 50% to start and 50% at launch (for fixed-price jobs, 50% on delivery). The start payment is due before work begins. The launch payment is due within 7 days of launch. If a payment is more than 14 days overdue, we may pause work until it's paid.

5. Timing

Full websites are usually live in 3–6 weeks; fixed-price jobs are delivered within 48 hours of having what we need from you (about a week for a small website). Every quote has a date on it. The date depends on us getting content, feedback and access from you when we need them. If those arrive late, the date moves by the same amount, and we'll tell you in writing.

6. What you own

You own the code, the domain, the accounts and the content. Your domain and other service accounts are registered in your name, and you pay those providers directly. We host the sites we build for free on our own hosting account and keep them running; if you'd rather host it yourself or move to someone else, we'll hand over every file and help point your domain at the new host, free, whenever you ask. Ownership of the code and design we create for you passes to you when the final payment is made. Third-party components (for example Shopify themes, apps or open-source libraries) stay under their own licences. We may show the finished work in our portfolio unless you ask us not to.

7. Fixes after launch

Fixed-price jobs include a round of changes after delivery (two for a small website). After that, small changes (a price, new hours, a photo swap) are A$40 each, and bigger changes are quoted first. For full projects, for 30 days after launch we fix, free of charge, anything that doesn't work as described in the quote. New features and changes to scope aren't fixes; we'll quote those separately.

8. Care

Small updates (A$49 a month: one small change each month) and Care (from A$150 a month: regular updates, fixes and monitoring) are optional and month to month. Each month's work is itemised so you can see what you paid for. Neither is needed to keep your site online; hosting is free either way. You pay each month in advance. You can cancel any time: care stops at the end of the month you've paid for, and you keep everything.

9. Leaving

There's no lock-in and no fee to leave. If you stop working with us, you keep your code, domain, accounts and content, and we'll hand over the site files and help move it, free.

10. Cancelling a project

If you cancel before work begins, we'll refund your start payment in full. Once work has begun, the start payment isn't refundable, and you keep everything completed up to that point.

11. What we don't guarantee

We do the work carefully and to a professional standard. We can't guarantee specific results such as search rankings, traffic or sales.

12. Liability

Our total liability for any claim is limited to the amount you paid us for the work the claim is about. We're not liable for indirect or consequential losses. Nothing here limits any rights you have under Australian Consumer Law.

13. Confidentiality

We keep your business information confidential. We only share it where the work requires it (for example with the platforms your site runs on) or where the law requires it.

14. Disputes

If something goes wrong, we'll try to sort it out by talking first. These terms are governed by the laws of New South Wales, Australia.

15. Changes to these terms

We may update these terms. The version that applies to your project is the one in place when you accepted your quote.
